These terms apply to the BuildMetric website and software (the “Service”), owned and operated by Nexonowa IT Solutions, C-121, Gaurs Siddhartham, Siddharth Vihar, Ghaziabad, Uttar Pradesh (“we”, “us”). By creating an account or paying for a subscription, you (“you”, the “Customer”) agree to these terms on behalf of yourself and the business you represent.
1. The Service
BuildMetric is online software for construction project management, including inquiries, site visits, bill of quantities, estimates, site tasks and related modules. It is provided over the internet as a subscription; no physical goods are delivered.
2. Account and eligibility
- You must be at least 18 years old and able to enter into a contract under Indian law.
- You must give correct company, GST and contact details and keep them up to date.
- You are responsible for every user you create, their login IDs and passwords, and everything done in your account.
- Tell us at once if you believe your account has been used without permission.
3. Free trial
New companies get a free trial of 14 days with full access. No payment is taken for the trial. When it ends, you need an active subscription to keep using the Service. Your data is kept so you can continue after paying.
4. Subscription, price and payment
- The subscription costs ₹8,999.00 per year plus GST at 18%, that is ₹10,618.82 per year in total, unless a different price is shown at the time you pay.
- Payments are processed by Razorpay. We do not see or store your card or bank details.
- The subscription runs for 12 months from activation and does not renew on its own.
- We may change the price for future periods. A change never applies to a period you have already paid for, and we will tell you at least 30 days before your renewal.
- A GST tax invoice is issued for every payment.
5. Refunds and cancellation
Refunds and cancellation are covered by our refund and cancellation policy, which forms part of these terms.
6. Your data
- Data you enter (projects, BOQs, estimates, parties, photos and the like) belongs to you. We use it only to provide the Service, as described in our privacy policy.
- You are responsible for the accuracy of what you enter and for having the right to upload it, including photos taken at sites.
- You can ask for an export of your data while your account is active, and for its deletion at any time.
7. Acceptable use
You must not:
- use the Service for anything unlawful, or to store content you have no right to;
- try to access other companies' data, test or break our security, or overload the Service;
- copy, resell or reverse-engineer the software, or share logins outside your company.
We may suspend an account that breaks these rules, after notice where possible.
8. Calculations and professional judgement
BuildMetric calculates quantities, weights, taxes and totals from the data and rates you enter. Standard values such as steel section weights are provided for convenience. You remain responsible for checking estimates, tax treatment and engineering decisions before you rely on them or send them to a client. Please confirm GST treatment with your tax adviser.
9. Availability and changes
We aim to keep the Service available at all times but cannot promise it will be uninterrupted. Planned maintenance is done outside working hours where possible. We may improve or change features; we will not remove a core feature you pay for without notice.
10. Limitation of liability
To the extent allowed by law, we are not liable for indirect losses such as loss of profit, contracts or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.
11. Termination
You may stop using the Service at any time. We may end the agreement if you seriously break these terms. After termination we keep your data for 90 days so you can export it, unless you ask us to delete it sooner.
12. Governing law
These terms are governed by the laws of India. Courts at Ghaziabad, Uttar Pradesh have exclusive jurisdiction.
